Here you can find out which of your data we store at Avidii, how we use and protect it.

Applicablity: 

This Privacy Policy applies to all visitors of the avidii website avidii.com (incl. contact/registration forms, support chat, blog/newsletter) and all users (hereinafter “users”) of the web and mobile app (iOS, Android) of the avidii platform (hereinafter all software components together the “platform”). For users, this Privacy Policy is an integral part of the Terms of Services (see clause 13 in the Terms of Services). In the context of identification and suitability tests as a Tutor on the platform, a specific Privacy Policy also applies, which will be made available separately.

Avidiis' Principles: 

  • It is a key concern for us to create a safe online environment for you.
  • We do not sell your personal data to third parties.
  • Our educational mission and your trust always comes above a profit-driven approach.
  • We do not display advertising on the avidii apps. Our mission is to provide you with an innovative learning experience, not to sell you products.
  • We want to give you access to and control over the information you give us. We take the protection of your information very seriously.
  • We take special precautions for our younger learners under the age of 18, including restricting learner user accounts to automatically block features that would allow a child to post or disclose personal information.

Responsibility Avidii: 

This privacy policy applies to the processing of personal data by Avidii AG, Spissenstrasse 8, CH-6047 Kastanienbaum, CHE-189.175.802, (hereinafter referred to as “Avidii”). Personal data is any information relating to you as an identified or identifiable individual, e.g. name, address, email, location data, user behaviour.

Third party responsibility:

If we use contracted service providers for individual functions of our offer or would like to use your data for advertising purposes, we will inform you in detail about the respective processes below. Our data protection declaration does not extend to websites, products or services of external providers, even if these are linked to our services or websites. These usually have their own data protection declarations, to which we refer at the appropriate points.

1. Responsible data processing by avidii

Avidii Code of Conduct: Avidii is a platform where children and young people (hereinafter “Learners”) learn online with Tutors (hereinafter “Learning Service”). Due to the age and sensitivity of learners as particularly vulnerable internet users, we are aware of our responsibility to protect the privacy and personal data (hereinafter all “User Data”) of all users, especially learners, in the platform at all times according to the highest possible state of the art and with the most appropriate organisational and procedural measures. In addition, we have imposed a code of conduct on ourselves, compliance with which is uncompromising for us.

We would like to explain the principles of our internal code of conduct to you below:

  1. For the assessment of the purpose and quality of the learning service, only the (objective/general) interest of the learners is decisive;
  2. We only collect user data that is essential to achieve the purpose and quality of the learning service on avidii;
  3. We process user data internally only if and to the extent that the learner has given his or her express consent. We only pass on user data to third parties if and to the extent that the purpose and quality of the learning service justify it.

Law and best practice: Avidii is committed to data protection compliance in accordance with Swiss law (Federal Data Protection Act, FADP and the corresponding ordinances) and the GDPR (European Data Protection Regulation). In addition, we also follow international best practice standards, particularly from the youth and education sectors, which we consider suitable and appropriate for our learning service (e.g. Data Protection Certificate Good Privacy, Student Privacy Pledge Signatory, COPPA, Children Online Privacy Protection Act).

Switzerland and abroad: Avidii is a Swiss company that operates worldwide. Personal data may be stored and processed in any country in which we or our contracted third party service providers operate. We may transfer personal data relating to you to recipients outside the country where the data was originally collected, including the United States. These countries may have different data protection laws than your country. However, we take appropriate steps to ensure that such transfers comply with applicable data protection laws and that your personal data is protected to the extent described in this Privacy Policy. If you are a resident of the European Economic Area (“EEA”) or Switzerland, we undertake to comply with applicable laws and to provide an appropriate level of protection when transferring your personal data to the US. The third party providers we choose comply with the requirements of the Privacy Shield Agreement between the EU and the US or between Switzerland and the US and adhere to the relevant requirements.

Changes to this privacy policy: This privacy statement is updated from time to time to accurately reflect enhancements to our service offerings and changes in data protection practices or the law. The reference to the last update date at the beginning of this statement indicates when it was last revised. Any changes made in a revision will be effective upon the posting of the updated statement (the update of this Privacy Policy will also be deemed to be an update of Section 13 of the Terms of Service with respect thereto. A further update in accordance with clause 1.5 Terms of Services is not necessary). In addition, we provide up-to-date information and notifications on our website regarding the Privacy Policy or the collection of personal data. Users will also receive such information in their personal avidii user account and in notices sent to their email address.

2. No sale of user data to third parties

We take data processing very seriously. Avidii does not sell or rent personal data to marketing agencies or non-corporate third parties. 

As a matter of principle, we only share your personal data within Avidii, and even then, only with those agencies and individuals who have a legitimate interest in doing so because the performance of their function requires it. Outside Avidii, personal data will only be disclosed to external service providers (third parties) who process personal data on our behalf and in accordance with our instructions, or if we are legally obliged or entitled to disclose it. We will only process personal data if you have given your express consent to do so, if the disclosure is permitted by law, is necessary for the performance of the (contractual) relationship with you, if there is a legal obligation to disclose the data, if the disclosure is necessary for the assertion, exercise or defence of legal claims and/or there is no reason to assume that you have an overriding legitimate interest in not disclosing the data.

If third parties process personal data on our behalf, this will only be done in accordance with our instructions. If the commissioned data processing takes place in countries that do not have an equivalent level of data protection in relation to Switzerland and/or the EU, we ensure equivalent protection by taking appropriate adequate precautions throughout the processing of your personal data.

We only share your personal data with trusted internal and external parties as described below:

  • Avidii: We share your personal data on a need-to-know basis only with selected staff personnel in order to provide our services and ensure internal administrative procedures.
  • Service providers: We share your personal data with a limited number of service providers whose services we use. These services may include identity verification, website hosting, data analytics, IT and infrastructure or email. The providers may need access to your personal data to carry out their activities. However, we only allow these providers to use your personal data to the extent necessary to provide the services on our behalf or as required by law. We also require these providers to contractually commit to protecting the personal data they process on our behalf. The majority of the external providers whose services we use are located in Switzerland, the EU and the USA.
  • Our users and third parties authorised by our users: We share personal data with users (e.g. learners, parents, learning coaches) when necessary to maintain a user account and provide our services. In addition, we also transfer data to third parties who are directly authorised by a user to receive personal data. The use of personal data by an authorised third party is subject to that third party’s privacy policy.
  • Corporate Transactions: In the event of a restructuring of some or all of our business, assets or stock, such as a reorganization, merger, acquisition, sale, joint venture, assignment, transfer, change of control or similar transaction, we may transfer Personal Data to third parties for the purpose of facilitating and/or completing the transaction.

Compliance with Laws and Damages: We will disclose personal information when we believe it is necessary to (i) comply with applicable laws or regulations, (ii) enforce our contractual rights, (iii) protect the rights, privacy, safety and property of avidii, you and others, and (iv) comply with government requests from courts, law enforcement agencies, regulators and other public bodies in and outside your country of residence.

3. No third party advertising within the Avidii apps

There is absolutely no third-party advertising within the Avidii apps. In the Avidii apps, learners should be able to focus entirely on learning and not be distracted by content that is not relevant to learning.

4. Your rights and choices

You have certain rights and choices regarding avidii’s use and disclosure of your personal information.

Opt out of receiving electronic correspondence: If you no longer wish to receive marketing-related emails from us, you have the option to opt-out of receiving such emails by clicking on the appropriate link in those emails. 

Viewing or changing personal data in your user account: If you wish to inspect, correct or update the personal data you have provided to us, log in to your Avidii user account or contact our Data Protection Officer by email hello.india@avidii.com, subject “Data Protection”.

Your data protection rights: Depending on your place of residence or domicile and the laws applicable there, you may have, and whenever Art. 12-23, GDPR applies, are guaranteed, among others, the following rights in relation to your personal data held by us:

  • The right to know whether Avidii holds personal data about you and, if so, the right to obtain a copy of that personal data;
  • Right to request Avidii to correct and update inaccurate, incomplete or outdated personal data;
  • Right to request Avidii to delete personal data in certain circumstances specified by law;
  • The right to request Avidii to restrict the processing of your personal data in certain circumstances, such as during the processing of another request you have made (e.g. to rectify your personal data);
  • The right to request Avidii to transfer your personal data to another company, where this is technically feasible and reasonably achievable.

Withdraw consent: Where the processing of your personal data depends on your consent given in advance, you have the right to withdraw this consent at any time. Furthermore, you also have the right to object to the processing of your personal data in certain cases. For the revocation, an informal communication by e-mail (to hello.india@avidii.com; subject: data protection) is sufficient. The lawfulness of the data processing carried out until the revocation remains unaffected by the revocation.

Exercise of your data protection rights: If you wish to exercise your data protection rights, please contact Avidii as indicated under Contact. We will respond to your request as promptly as possible to the extent required by applicable law. We can only respond to your request if we actually hold personal data relating to you. If you believe that we have not provided you with sufficient information, you are free to contact the relevant data protection authority in your country.

Before we can respond to your request, we will need to establish your identity for your own security, for example by checking that the email address used to send the request matches the email address we hold. If the processing of personal data relating to you is no longer necessary for the provision of our services or our website, we will not hold, collect or process any additional data to establish your identity in order to respond to your request.

Deletion of personal data: Your personal data will be deleted as soon as the purpose for which it was collected has been fulfilled or is no longer applicable. If you only visit our website, the maximum period is 2 years from the last interaction with you. If you have a contractual relationship with us, e.g. as a user (learner/parent/ tutor), we may keep your personal data for up to 10 years from the date of our last interaction with you and with your consent, or longer if required by law. After this time we will destroy the data without further notice.

If you believe that Avidii is not or not sufficiently complying with its obligations under data protection law, we would like to inform you of your right to lodge a complaint with the competent supervisory authority in your country at any time.

5. Security measures to protect your data

We have implemented technical and organisational measures to protect personal data that we process and that is in our custody and control. 

Security and Safekeeping: We take reasonable steps to ensure an appropriate level of security commensurate with the risk involved in processing personal data. To this end, we employ organisational, technical and administrative measures designed to protect personal data in our custody from unauthorised access, damage, loss, manipulation and misuse. Only a limited number of persons who need your data for the performance of their duties can access your personal data. 

Unfortunately, given the current state of technology, no data transmission or storage system is 100% secure. 

If you believe that the exchange of information with us is no longer secure (for example, if you suspect that the security of your user account is no longer guaranteed), please contact us immediately at hello.india@avidii.com (subject “Security”). 

If you are a user, we will retain your personal data for the duration of the service provision. To the extent necessary to comply with our legal and regulatory obligations, to fulfil our contractual obligations with you (Terms of Service) and to prevent fraud, we may retain your personal data beyond the end of the service provision period, even if you close your user account. We also retain personal data for tax, audit and financial reporting purposes where specified in our contracts. In all cases, data retention will be in accordance with legal requirements and retention periods.

5.1 Website

On our avidii.com website, we use the widely used Transport Layer Security Procedure (TLS) in conjunction with the highest encryption level supported by your browser. As a rule, this is a 256-bit encryption. You can tell whether an individual page of our website is transmitted in encrypted form by the “https://” address line of your browser and the lock symbol in the browser line. In addition, we use suitable technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction and/or unauthorised access by third parties. Our security measures are continuously improved in line with technological developments. 

All contact forms on our websites are also TSL/SSL-encrypted so that data entered there cannot be accessed by unauthorised third parties. This applies equally to forms used for registration or in the login process, to any online cancellation form, newsletter registrations and other forms through which personal data is collected.

5.2 Platform(avidii-Apps)

In our platform (avidii apps) we use the highest, technical industry standards. Our security technology includes:

  • SSL/TLS encryption for all connections to and between Avidii apps. All collected data is encrypted. This also applies to backups. We use the latest encryption standards and APIs, such as 256-bit encryption with SHA-256 hashing;
  • Avidii apps include strong identity and access management controls, as well as the highest application and data controls;
  • User logins apply OAuth2, JSON web tokens and OpenID Connect;
  • We have strong data loss prevention (DLP) controls, including copy/paste prevention;
  • We use zero-trust security;
  • API’s that are used are verified for the Avidii platform to ensure there are no vulnerabilities. All API’s have strong security measures in place to protect data and prevent unauthorised access. All API’s are verified to prevent eavesdropping of confidential information coming back from the user to the app server database;
  • Avidii apps comply with relevant security frameworks;
    Redundant data storage on the servers including ongoing backups.

6. Data processing on the avidii website

6.1 Website visit without registration

Principle and nature of the data:

In principle, you can visit the avidii website https://in.avidii.com without actively disclosing any data or information. In certain areas of the website, we will refer you to additional contact options so that you can obtain further information about our platform and the services available on it. When you access our website, our website server temporarily stores information about your access. In particular, this is:

  • IP address;
  • Date and time of your visit/request;
  • Time zone difference from Greenwich Mean Time (GMT);
  • Content of the request (specific page);
  • Access status/HTTP status code;
  • Amount of data transferred in each case;
  • Website from which the request comes (so-called referrer URL);
  • URL of the retrieved files;
  • Browser type/version and name of the access provider;
  • Operating system of the end device and its interface;
  • Language and version of the browser software;
  • Plug-ins;
  • Add-ons.

Purpose and legitimate interest: We use this data to ensure a smooth connection and the best possible use of our website, to evaluate system security as well as stability and for other administrative purposes (legal basis is, among others, Art. 6 para. 1 p. 1 lit. f DSGVO). The basis for this data processing is our legitimate interest (or the legitimate interest of a third party) in using personal data to ensure that we provide our services in the best possible way.

6.2 Blog & Newsletter

To send our newsletter, we need an e-mail address from you. Verification of the e-mail address provided is necessary and receipt of the newsletter requires your consent. Supplementary data is not collected or is voluntary. The data is used exclusively for sending the newsletter. The data provided during newsletter registration will be processed exclusively on the basis of your consent in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO. For revocation, an informal message by e-mail or you unsubscribe via the “unsubscribe” link in the newsletter is sufficient. Data entered to set up the newsletter will be deleted in the event of unsubscription. If this data has been transmitted to us for other purposes and elsewhere, it will remain with us.

6.3 Contact / registration forms

When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, name and telephone number, if applicable) will be stored by us in order to answer your questions, including follow-up questions, if applicable. The processing of this data is based, among other things, on your consent in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO. We delete the data accruing in this context after the storage is no longer necessary or restrict the processing if there are statutory retention obligations.

6.4 Support-Chat

The data collected when using the chat (for example, questions) and related data, such as IP addresses, are stored. The content remains on our platform until it has been completely deleted or had to be deleted for legal reasons.

The storage of chat histories is based on your consent pursuant to Art. 6 para. 1 S, 1 lit. a DSGVO. The collected data may be used by us for quality assurance purposes. This use is based on your consent according to Art. 6 para. 1 S. 1 lit. a DSGVO as well as according to Art. 6 para. 1 S. 1 lit. f DSGVO.

6.5 Downloads from our Website

We sometimes make content available on our website that can be downloaded by visitors (e.g. white papers, factbooks, guides). Prior to downloading this content, we request certain personal data and information, which we use solely for the purposes stated at the time of data collection. On a voluntary basis, the visitor may also register for the newsletter or other services before downloading, which may lead to the data processing mentioned there. This data processing is based on your consent pursuant to Art. 6 para. 1 sentence 1 lit. a DSGVO.

6.6 Links to external websites of third parties

Our avidii.com website may contain links to other third party websites. Please be aware that we are not responsible for the content or privacy practices of these other websites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every other site that collects personally identifiable information. Despite careful monitoring of content, we do not accept any liability for the content of external links. The operators of linked sites are solely responsible for their content.

6.7 Cookies

Cookies are small text files that are stored in a computer’s browser directory. They help website operators understand how visitors use websites. They remember a user’s login details and store personal settings for websites.

We use cookies in accordance with our privacy policy:

  • to ensure that our services run smoothly;
  • to detect and prevent fraud;
    understand how visitors use and interact with our website; and
    analyse and improve services.

    There are two main types of cookies that can be set:
  • First-party cookies: these cookies are placed and read directly by Avidii while you are using our services;
  • Third-party cookies: these cookies are not placed by Avidii, but by other providers such as Google for website analytics. 

Cookies are important because they help us to provide our services effectively and safely. Below is a list of commonly used cookies and the purpose of each. This list is not exhaustive and describes the main reasons why we commonly use cookies. 

Some cookies are important to the operation of our website and services and make them usable and secure in the first place by enabling basic functions such as page navigation and access to secure areas of the website. We use such cookies for the following purposes, among others:

  • Authentication: The programme remembers your login status so that you do not have to log in again and again when navigating our website and your Avidii apps user account.
  • Fraud prevention and detection: Cookies and similar technologies that we use on our website provide us with information about the computers and browsers used to access the Services. This information allows us to monitor our services and detect potentially harmful or illegal activity.
  • Security: User data is protected from unauthorised access.

Avidii uses preference cookies to remember preferred settings and to recognise you as a user when you use our services repeatedly.

Analytics cookies help us understand how visitors interact with our services. We use such cookies for the following purposes, among others:

  • Website features and services: The programme remembers how you prefer to use our services so that you do not have to reconfigure your settings every time you log in to your account.
  • Analysis and improvement of our services: Our website and services work better for you this way. Cookies help us understand how visitors arrive at our website. They provide us with insights into what improvements or optimisations we need to make to our website and services.
  • Pixel tags (also called “web beacons” or “clear GIFs”): These may be used in conjunction with some services to, among other things, track user actions (e.g. email recipients), assess the success of our marketing campaigns and compile statistics on the use of our services and response rates.
  • Third-party analytics: To collect and analyse information about the use of the services and to report activity and trends using Google Analytics. This feature may also collect information about the use of other websites, apps and online resources. Information on Google’s methods can be found on the Google website. We use cookies and similar technologies on avidii.com to target advertisements for Avidii services on other websites you visit and to track your activity in connection with those advertisements.

You can also disable certain cookies, except for cookies that are necessary to provide our services. You may be able to manage your cookie settings in your browser and disable Avidii cookies. Check your internet browser’s help pages or follow the links below to find out about your choices. If you disable cookies, some features of our website or services (Avidii apps) may not behave as intended.

6.8 Social-Media-Plugins

We have embedded plugins in the form of “social media buttons” of the providers we use on our platform. You can see which plugin belongs to which provider by the respective logo with which the plugin is marked. When you call up a page of our platform on which such a plug-in is implemented, a connection is automatically established with the respective provider of the plug-in between your browser and the provider’s servers and a cookie is set by the provider on the end device you are using. Data transmission may already take place at this point, even if you yourself do not have an account with the respective operator of the social network or have an account there but are not logged in there at the moment you visit our website. In addition, data is transmitted to the provider as a result of further interactions with the respective social plugin (e.g. clicking the “Like me” button on Facebook, re-tweet button on Twitter).

The collected data is usually used by the provider for the purpose of advertising and market research by creating usage profiles from your usage behaviour. These in turn can be used by the providers to play interest-based advertising to you. You have a right of revocation against the creation of user profiles. To exercise this right, you must contact the respective provider. If you have an account with the provider, your usage data may be linked to it. To prevent such a linking of your data, you can log out of the provider’s service before visiting our site.

You can find out for what purpose and to what extent data is collected by the provider in the respective data protection declarations of the providers, which are communicated below. We ourselves have no influence on what data is collected and how this data is used by the provider.

6.9 Facebook/Instagram Remarketing (Visitor Pixel)

On our avidii.com website, we use the “Visitor Action Pixel” of Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”) with your consent. With its help, we can track the actions of users after they have seen or clicked on a Facebook ad. This allows us to track the effectiveness of Facebook ads for statistical and market research purposes.

The data collected in this way is anonymous to us, which means that we do not see the personal data of individual users. However, this data is stored and processed by Facebook, about which we inform you according to our level of knowledge. Facebook may link this data to your Facebook account and also use it for its own advertising purposes, in accordance with the data usage policy (Facebook). You may allow Facebook and its partners to serve ads on and off Facebook. A cookie may also be stored on your computer for these purposes.

6.10 TikTok Remarketing (Visitor Pixel)

On our website https://in.avidii.com, with your consent, we use the “visitor action pixel” of TikTok Technology Limited or TikTok Information Technologies UK Limited (“TikTok”). This allows us to track the actions of users after they have seen or clicked on a TikTok advert. This allows us to track the effectiveness of TikTok ads for statistical and market research purposes.

The data collected in this way is anonymous to us, which means that we do not see the personal data of individual users. However, this data is stored and processed by TikTok and we will inform you of this to the best of our knowledge. TikTok may link this data to your TikTok account and also use it for its own promotional purposes, in accordance with the Data Use Policy (TikTok) https://www.tiktok.com/legal/privacy-policy-eea?. You may allow TikTok and its partners to serve advertisements on and off TikTok. A cookie may also be stored on your computer for these purposes.

6.11 Snapchat Remarketing (Visitor Pixel)

On our website https://in.avidii.com, we use the “visitor action pixel” of Snap Inc (“Snapchat”) with your consent. This allows us to track the actions of users after they have seen or clicked on a Snapchat ad. This allows us to track the effectiveness of Snapchat ads for statistical and market research purposes.

The data collected in this way is anonymous to us, meaning we do not see the personal data of individual users. However, this data is stored and processed by Snapchat and we will inform you of this to the best of our knowledge. Snapchat may link this data to your Snapchat account and also use it for its own promotional purposes, in accordance with the Data Use Policy (Snapchat) https://snap.com/privacy-policy. You may allow Snapchat and its partners to serve ads on and off Snapchat. A cookie may also be stored on your computer for these purposes.

7. Data processing in the platform (avidii app)

7.1 User Account

General: To use certain functions, you can register on our Avidii apps (web/mobile, iOS, Windows, Android). The data transmitted is used exclusively for the purpose of using the respective offer or service. Mandatory information requested during registration must be provided in full. Otherwise, we will reject the registration. In the event of important changes, for example for technical reasons, we will inform you by SMS and/or e-mail. The SMS and/or e-mail will be sent to the mobile number and/or address provided during registration. The processing of the data entered during registration is based, among other things, on your consent (Art. 6 para. 1 p. 1 lit. a DSGVO). We store the data collected during registration for the period that you are registered on our website. Your data will be deleted if you cancel your registration. Statutory retention periods remain unaffected.

The data transmitted for the use of chargeable services is used exclusively for the purpose of using and processing the respective offer or service. Mandatory data requested during the order process must be provided in full. Otherwise we will reject the order. Payment processing by credit card is carried out by the provider Stripe. Inc, 510 Townsend Street, San Francisco, CA 94103, USA. If and to the extent applicable, you can find the privacy policy of Stripe. Inc. at: https://stripe.com/privacy.

In the event of important changes, such as for technical reasons, we will inform you by SMS and/or email. The SMS and/or email will be sent to the mobile number and/or address provided during registration. The processing of the data entered when ordering the paid membership is based, among other things, on your consent (Art. 6 para. 1 sentence 1 lit. a DSGVO) as well as on Art. 6 para. 1 sentence 1 lit. b DSGVO; the processing of the data is permitted for the fulfilment of the contract and/or pre-contractual measures. This also applies in particular with regard to the data processed for payment processing. We store the collected data for the period, the duration of the contract. Your data will be deleted if the contract is terminated. Statutory retention periods remain reserved.

Learner data: Avidii only has access to such data of a learner as an app user if the learner enters the data themselves and it is necessary to provide the learning service. The type of learner data we collect depends on how the learner and/or their parents use our services. Below is a final list of the only permitted purposes:

  • We will never use a learner’s personal profile for any purpose other than to support the educational/school purposes authorised by the learner and/or their parents;
  • The purpose and nature of the use must always be covered by Avidii’s Terms of Services and Code of Conduct and explicitly authorised by the learner and/or their parents;
  • We will never use learner data for advertising, including but not limited to behavioural targeting of advertising – i.e. advertising that uses any behavioural information of a learner. We do not allow this through Avidii, nor for any of our third party providers.
7.2 Support-Chat

8.2 Google AdWords and Google Conversion-Tracking

AdWords is an online advertising programme: As part of the online advertising programme, we work with conversion tracking. After a click on an ad placed by Google, a cookie is set for conversion tracking. Cookies are small text files that your web browser stores on your end device. The cookie allows Google and us to recognise that you clicked on an ad and were redirected to our website or platform (avidii apps).

avidii stores all data on servers that are technologically and in terms of infrastructure located in secure, professional data centres (hosting).
